Welcome to Binmo (the “Platform” or “APP”). The Platform is provided and controlled by Guangzhou Chuqing Interactive Network Technology Co., Ltd..
The Privacy Policy("Policy") was written in English (US) and will be the agreement between You and Guangzhou Chuqing Interactive Network Technology Co., Ltd. while you are using Binmo.

To the extent any translated version of this Policy conflicts against the English version, this English version prevails.

By installing, using, registering to or otherwise accessing the services, you agree to this privacy policy and give an explicit and informed consent to the processing of your personal data in accordance with this privacy policy. IF YOU DO NOT ACCEPT AND AGREE WITH OUR PRIVACY POLICY THEN YOU MUST NOT ACCESS OR USE THE APP.

1. Binmo user's information

To join Binmo you will provide us with information about you to make friends easier,such as your nickname, your picture, your gender, your date of birth. Because you control your user profile, these details are available to you at any time by accessing your “Profile” page, which gives you the chance to correct or update your information at any time by just logging in to Binmo.
What information does Binmo collect Once you have created a Profile, we will automatically track certain information such as your IP, device locale, timezone. And we also collect infomation about WiFi access points as well as other location information about your longitude and latitude. We may from time to time allow our employees to use the product for testing and user engagement purposes.
For safety and security and to ensure you have the best possible user experience, we require users to verify their accounts (because we want to make sure you are not a robot!) and might ask for your phone number or Facebook Account. We won't publicize your phone number without your consent.
When you use our Service, our servers automatically record certain log file information, including your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information. The information allows for more accurate reporting and improvement of the Service.

In addition, our app collects Installed application information with ishuemi SDK, in order to fraud prevention, security, or compliance with laws. For example, monitor whether the device is in the root environment, whether there is a hook risk, and whether it is running on a real device, etc.

How we use your information 

In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive to:
1. remember information so you will not have to re-enter it during your visit or the next time you visit the Service;
2. provide personalized content and information to you and others, which could include online ads or other forms of marketing;
3. provide, improve, test, and monitor the effectiveness of our Service;
4. develop and test new products and features;
5. monitor metrics such as total number of visitors, traffic, and demographic patterns;

7. automatically update the APP on your device Binmo or other Users may run contests, special offers or other events or activities ("Events") on the Service. If you do not want to participate in an Event, do not use the particular Metadata (i.e. hashtag or geotag) associated with that Event.


If I put other information about me on the Binmo, what does Binmo do with it?
Binmo is a free social Live app, which provides you to voice chat with your friends. In the app, you can find new friends, go Live, join a Live, send gifts, get profits by receiving gifts. When using the service you should assume that anything you post or submit will be publicly viewable and accessible, both by users of the Service and non-Users of the Service. The viewers may share your information to other sites, such as Facebook, Instagram, WhatsApp, etc. You can also use our messaging/charting features which allow you to communicate with other users in public and/or privately. We recommend and encourage you (and all our users) to think carefully about the information you disclose about yourselves. We also do not recommend that you put email addresses, URLs, instant messaging details, phone numbers, full names or addresses, credit card details, national identity numbers, drivers’ licence details and other sensitive information in your Profile which is open to abuse and misuse.

Please be careful about posting sensitive details about yourself on you Profile such as your religious denomination and health details. While you may voluntarily provide this information to us when you create your Profile, including your sexual preferences and ethnic background, there is no requirement to do so. Please remember that photographs or any video clips that you post on Binmo may reveal these kinds of sensitive personal data. Where you do upload and choose to tell us sensitive information about yourself, you are explicitly consenting to our processing your information and making this public to other users.

When you post information about yourself or use the messaging, the amount of personal information you share is at your own risk. If you post anything that is inconsistent with our Terms of Service we reserve the right to terminate your account.
Can Binmo collect information about me from other sites I use, such as Facebook?

You can register with third party accounts on Binmo. Remember that when you register with a Binmo partner, you are also giving them personal information, so we recommend that you read their privacy policies as Binmo does not control how they use their information.

If you have registered on one of our partner websites, or you have verified your account via a partner website, we may connect your Binmo profile with your profile on such partner website. We may do this by way of new products and applications which we introduce from time to time, including new products powered by our group companies.

Does Binmo collect any other personal information about me?

If you contact our Customer Support team via feedback features in our Service or through any other means, we may receive your email address, your IP address as well as the information you send to us to help resolve your query. When you provide feedbacks to us you automatically consent us to receive and use such information. You also consent that we are allowed to keep records of our communications with you, including any complaints that we receive from you about other users (and from other users about you).

Does Binmo use my personal information for any other purpose?

We may use material that you post on the open access areas of Binmo in advertising and promotional materials on our partner sites and partner products. We believe these uses allow us to improve our site and better tailor your online experience to meet your needs.

When I put information about myself on Binmo, what do the other users see?

To ensure you get to meet as many people as possible on Binmo, other users get to see all information on your Profile. Any information you choose to provide should reflect how much you want other Binmo users to know about you.


What am I allowed to do with other user’s personal information?

Use it to meet new friends and make new contacts! Beware that you may not use other users' information for commercial purposes, to spam, to harass, to threat, or in any illegal activity. Binmo reserves the right to terminate accounts from those who misuse other users' information.


2. Third parties

Does Binmo sell my information to other parties?

Not at all. We do not sell or rent out any personal information about you to any third party. Binmo discloses aggregated non-personal data for marketing and promotional purposes. That means we do not disclose any information that could be used to identify you.

We may share aggregated information with such parties as Facebook that includes your personal information (but which doesn’t identify you directly), together with other information including log data with third parties for industry analysis and demographic profiling.

Binmo also wishes to maintain a healthy community, and we will cooperate with all third parties to enforce their intellectual property or other rights. We will also cooperate with law enforcement enquiries from within and/or outside your country of residence. This may include disclosing your personal information to government or law enforcement agencies, or private parties, to protect the rights, property or safety of Binmo and the users of APP, or to protect public interest when we have a good faith belief that disclosure is required by law or when we, in our discretion, believe that disclosure is necessary to protect our legal rights, or those of third parties and/or to comply with a judicial proceeding, court order, or legal process served on us. In such cases, we may raise or waive any legal objection or right available to us.


3. Data storage

Binmo is a global social application operating through servers located in a number of countries around the world, including the United States. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as you enjoy in your country of residence. By submitting your personal information, or by choosing to upgrade the services you use, or by making use of the applications available on Binmo, you agree to the transfer of your personal information to, and storage and processing of your personal information in, any such countries and destinations.


4. Security

How does Binmo protect my personal information?

Binmo has implemented reasonable and appropriate security measures to protect and prevent the loss, misuse, and alteration of the information under our control, including your personal information. Binmo uses reasonable security measures to safeguard the confidentiality of your personal information such as secured servers using firewalls. Our technical experts at Binmo work hard to ensure your secure use of our site.

We cannot guarantee the security of your personal data while it is being transmitted to our site. Any transmission is at your own risk. Once we have received your information we have procedures and security features in place to try to prevent unauthorized access.

How do I help keep my information secure?

You may not disclose your password to any third parties or share it with any third parties. If you lose your password or give it out, your personal information may be compromised. If that happens, please report it to our customer service via Feedback. Binmo cannot be held responsible for your failure to keep your password secure and failure to do so may violate our Terms of Service.

5. Your rights

You can review and revise your profile information at any time. Once you register, you will be able to review and change much of your personal information.

6. Account Deletion

How to delete my account?
You can delete your account through [Me-Settings- Account Deletion] and select [Confirm Account Deletion] under the conditions for account deletion. We will process it for you as soon as possible within three working days after we receive your deletion request and verify your user identity.
When it verified, except for retaining necessary information (such as your transaction information in Binmo), your personal information will be removed from Binmo.

Account Deletion Notice
Before deleting your account, please read the following important reminders carefully. After the account is deleted, you will no longer be able to use the account, including but not limited to:
1.To protect your using rights of remaining services, after the account is deleted, your account data will be reserved for 60 days.
2. When all data cleared, you will not be able to log in and use Binmo, and you will not be able to retrieve any personal information.
3. The account will be released from the binding or authorization relationship with other products, and cannot be retrieved.
4. After the account is deleted, your assets and various paid rights and interests in the App will be cleared, including the rights and interests that have been generated but not consumed or expected rights in the future.
5. The deletion of your Binmo account does not mean that your account behavior and related responsibilities before the deletion are exempted or mitigated.

7. Legal Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of China, without regard to the choice of law principles. Any dispute arising out of or in connection with this Terms, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the China International Arbitration Centre(“HKIAC”) in accordance with the Arbitration Rules of the HKIAC for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be China.

You acknowledge any information transmitted may be intercepted. Binmo does not warrant that its service or the servers which make the Service available or electronic communications transmitted are free from viruses, worms, horses and other items of a destructive nature.

Binmo does not endorse or make any representations or warranties about the contents, products, services available, or the security at such third party web sites. Binmo'S TOTAL LIABILITY TO YOU FOR ALL LOSSES, DAMAGES, AND CAUSES OF ACTION, INCLUDING BUT NOT LIMITED TO THOSE BASED ON CONTRACT, TORT OR OTHERWISE, ARISING OUT OF YOUR USE OF APP, ITS CONTENT OR LINKS, SHALL NOT EXCEED THE AMOUNT OF USD 500 DOLLARS.

Prohibited Usage

You will not use the Service for any purpose that is unlawful or not allowed by Binmo. You may not use our Service or its contents in any manner which could damage, disable, overburden, or interfere with any person to use this Service. You may not attempt to gain unauthorized access to the Service other accounts, computer systems or networks connection through hacking, password mining or any other means. You may not use or attempt to use this Service through any means unanticipated or intentionally made available by Binmo.

IP Protection

Binmo respects intellectual property laws and has adopted the following policy toward intellectual property infringement on its products/services. Reporting Instances of Intellectual Property Violations If you believe that any materials or contents in Binmo‘s APP infringe copyrights, trademarks, patents, or trade secrets (collectively “IP Right”), please send a notice of IP Rights infringement to Binmo's agent with a physical signature of the owner of the IP Right that has been allegedly infringed.

1. Identification of the material that is claimed to be infringing, including its location on the Binmo network, with sufficient detail so that Binmo is capable of finding the material and verifying its existence. Please address your intention to remove the alleged infringed materials.

2. Contact information, including your name, address, telephone number, and email address.

3. A statement by you that you have a good faith belief that the disputed use is not authorized by the IP Right owner, its agent or law.

4. A statement by you that the above information in your Notice is accurate and that, under penalty of perjury, you are the IP Right owner or authorized to act on the IP Right owner's behalf.

5. Agree to undertake compensation responsibility to Binmo for any false and incorrect information addressed in above statements.

Welcome to Binmo (the “Platform” or “APP”). The Terms of service was written in English (US)and will be the agreement between You and Guangzhou Chuqing Interactive Network Technology Co., Ltd. while you are using Binmo.
This is an agreement between Binmo Team, the owner and operator of Binmo and Binmo Client and Content (collectively, including all content available through the Binmo Website- http://www.Binmotalk.com, Binmo Client and Content ), and you ("you" or "You"), a user of the Service. And there is no tolerance for objectionable content or abusive users in Binmo. If you do not agree to any of these terms, you may not use the Service.

Binmo Service
These Terms of Service apply to all users of the Binmo Service. Binmo provided status information may contain links to third party websites that are not owned or controlled by Binmo. Binmo has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Binmo will not and cannot censor or edit the content of any third-party site. By using the Service, you expressly acknowledge and agree that Binmo shall not be responsible for any damages, claims or other liability arising from or related to your use of any third-party website.

Binmo Access

1. Subject to your compliance with these Terms of Service, Binmo hereby grants you permission to use the Service, provided that: (1) your use of the Service as permitted is solely for your personal, noncommercial use; (2) you will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without Binmo's prior written authorization; (3) you will not attempt to reverse engineer, alter or modify any part of the Service; and (4) you will otherwise comply with the terms and conditions of these Terms of Service.

2. In order to access and use the features of the Service, you acknowledge and agree that you will have to provide Binmo with your phone number, as well as the phone numbers of third parties whom you wish to use the Service with. When providing your phone number, you must provide accurate and complete information. You hereby give your express consent to Binmo to use the phone numbers you provide for use in providing you access and use of the Service. You may never use another person's phone number without their permission. You are solely responsible for the status message that is displayed for your phone number. You must notify Binmo immediately of any breach of security or unauthorized use of your phone. Although Binmo will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Binmo or others due to such unauthorized use

Intellectual Property Rights

The design of the Binmo Service along with all text, scripts, graphics (including stickers), interactive features and the like made available in connection with the Binmo Service (collectively, the "Binmo Client and Content"), except all User Status Submissions (as defined below), and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Binmo, subject to copyright and other intellectual property rights under United Arab Emirates and foreign laws and international conventions. Subject to these Terms of Service, you are granted a personal, non-exclusive, non-transferable, revocable, limited license to install and use, only in connection with the Service, the Binmo Client and Content for personal and non-commercial purposes only. The Service, including the Binmo Client and Content, is provided to you as is for your information and personal non-commercial use only. Binmo reserves all rights not expressly granted in and to the Service and the Binmo Client and Content. You agree to not engage in the use, copying, distribution or other exploitation of any of the Binmo Client and Content other than expressly permitted herein, including any use, copying, or distribution of User Status Submissions of third parties obtained through the Service for any commercial purposes. You further agree not to use the Binmo Client and Content in a manner that would infringe or violate the rights of any third party and that we are not in any way responsible for any such use by you.

Sensitive Information Feedback

1. There is no tolerance for objectionable content or abusive users on Binmo.

2. Binmo uses AI technology to automatically identify porn. Any one who post porn on profile, background or room will be blocked within 24 hours.

3. Binmo admins have rights to supervise and investigate. Users can immediately report abusive, suspicious, or inappropriate online behavior. User account can be banned based on the severity of his behavior.

4. To prevent harass, users have rights to kick other users out of their room and put them in black list.

User Status Submissions

1. The Binmo Service permits the submission of status text and other communications submitted by you and other users ("User Status Submissions") and the hosting, sharing, and/or publishing of such User Status Submissions. As clarified in the following section, you retain your ownership rights in your User Status Submissions. You understand that whether or not such User Status Submissions are published, Binmo does not guarantee any confidentiality with respect to any submissions.

2. You shall be solely responsible for your own User Status Submissions and the consequences of posting or publishing them. Because Binmo is only acting as a repository of data, user submitted statuses do not necessarily represent the views or opinions of Binmo, and Binmo makes no guarantees as to the validity, accuracy or legal status of any status. In connection with User Status Submissions, you affirm, represent, and/or warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize Binmo to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Status Submissions to enable inclusion and use of the User Status Submissions in the manner contemplated by the Service and these Terms of Service; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the User Status Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Status Submissions in the manner contemplated by the Service and these Terms of Service. To be clear: you retain all of your ownership rights in your User Status Submissions, but you have to have the rights in the first place. However, by submitting the User Status Submissions to Binmo, you hereby grant Binmo a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Status Submissions in connection with the Binmo Service and Binmo's (and its successor's) business, including without limitation for promoting and redistributing part or all of the Binmo Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each subscriber to your status on the Binmo Service a non-exclusive license to access your User Status Submissions through the Service, Email, and mobile phone and to display parts of User Status Submissions as permitted through the functionality of the Service and under these Terms of Service. The foregoing license granted by you terminates once you remove or delete a User Status Submission from the Binmo Service.

3. In connection with User Status Submissions, you further agree that you will not: (1) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Binmo all of the license rights granted herein; (2) publish falsehoods or misrepresentations that could damage Binmo or any third party; (3) submit material that is unlawful, obscene, defamatory, libelous, threatening, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (4) post advertisements or solicitations of business; (5) impersonate another person; (6) send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs; (7) interfere with or disrupt the integrity or performance of the Service or the data contained therein; or (8) attempt to gain unauthorized access to the Service or its related systems or networks.

4. Adult content must be identified as such. Binmo does not endorse any User Status Submission or any opinion, recommendation, or advice expressed therein, and Binmo expressly disclaims any and all liability in connection with User Status Submissions. Binmo does not permit copyright infringing activities and infringement of intellectual property rights via its Service, and Binmo will remove all Content and User Status Submissions if properly notified that such Content or User Status Submission infringes on another's intellectual property rights. Binmo reserves the right to remove Content and User Status Submissions without prior notice. Binmo may also terminate a user's access to its Service, if they are determined to be a repeat infringer, or for any or no reason, including being annoying. A repeat infringer is a User who has been notified of infringing activity more than once and/or has had a User Status Submission removed from the Website more than twice. An annoying person is anyone who is (capriciously or not) determined to be annoying by authorized Binmo employees, agents, subagents, or super agents. Binmo also reserves the right to decide whether content or a User Status Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to excessive length or limited interest. Binmo may remove such User Status Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

5. You understand that when using the Binmo Service you will be exposed to User Status Submissions from a variety of sources, and that Binmo is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Status Submissions, and that such User Status Submissions are not the responsibility of Binmo. You further understand and acknowledge that you may be exposed to User Status Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Binmo with respect thereto, and agree to indemnify and hold Binmo, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

6. Binmo permits you to link to materials on the Service for personal, non-commercial purposes only. Commercial versions are available under separate licensing and terms. Binmo reserves the right to discontinue any aspect of the Binmo Service at any time. YOU agree THAT YOUR USE OF THE Binmo SERVICE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, Binmo, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. Binmo DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE Binmo SERVICE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY USER STATUS SUBMISSION OR OTHER ADVERTISING, AND Binmo WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. IN NO EVENT SHALL Binmo, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE Binmo CLIENT AND CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT Binmo SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. YOU AGREE THAT YOU WILL NOT USE THE PRODUCT WHILE OPERATING A MOTOR VEHICLE, FOR TIME-CRITICAL OR EMERGENCY SERVICES OR EVENT OR FOR ANY OPERATION WHERE INJURY, DEATH, OR ECONOMIC DAMAGE COULD OCCUR. Binmo makes no representations that the Binmo Service is appropriate or available for use in all the locations. Those who access Binmo or use the Binmo Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

Indemnity

You agree to defend, indemnify and hold harmless Binmo, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Binmo Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Status Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Binmo Service. We don't support or encourage illegal consumption of alcohol or tobacco.

Assignment

General

You agree that: (i) the Binmo Service shall be deemed a passive server that does not give rise to personal jurisdiction over Binmo, either specific or general, in jurisdictions other than BVI; and (iii) that you agree to subject to the jurisdiction of China in the event of any legal dispute. These Terms of Service shall be governed by the internal substantive laws of China, without respect to its conflict of laws principles. Any claim or dispute between you and Binmo that arises in whole or in part from the Binmo Service shall be decided exclusively by a court of competent jurisdiction located in China. Privacy and any other legal notices published by Binmo, shall constitute the entire agreement between you and Binmo concerning the Binmo Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiverof such term or any other term, and Binmo's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Binmo reserves the right to amend or modify these Terms of Service at any time, and it is your responsibility to review these Terms of Service for any changes. Your use of the Binmo Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND Binmo AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE Binmo SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Legal Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of China, without regard to the choice of law principles. Any dispute arising out of or in connection with this Terms, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the China International Arbitration Centre(“HKIAC”) in accordance with the Arbitration Rules of the HKIAC for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be China.

In-App Purchase and Subscription

In-App Purchases.

Binmo offers virtual items, which we call “gold coins”, and additional services for purchase through the App Store, Google Play or other application platforms ("in-app purchases"). When you make in-app purchases, you will be prompted to enter details for your account with the mobile platform you are using (e.g. Apple, Android, etc.)"your IAP Account"), and your IAP Account will be charged for the in-app purchase in accordance with the terms disclosed to you at the time of purchase as well as the general terms for in-app purchases that apply to your lAP Account, and bear applicable taxes. The price of the gold coins will be displayed at the point of purchase. All charges and payments will be made in the currency specified at the point of purchase through the relevant payment mechanism. Currency exchange settlements, foreign transaction fees and payment channel fees, if any, are based on your agreement with the applicable payment provider.

Subscription Tips :If you purchase an auto-recurring periodic subscription through an in-app purchase, your IAP Account will be billed continuously for the subscription until you cancel in accordance with the platform terms. In all cases, please refer to the terms of your application platform which apply to your in-app purchases. You agree to pay your subscription fee in advance of receiving any such Subscription Service. You are responsible for all charges incurred under your account. You agree that if you purchase Subscription Services through the Application Store, all payment related questions, issues, disagreements, and/or disputes shall be handled in accordance with the terms of service or other legal agreements that govern your use of a given payment processing service and/or method, and in no event will Binmo have any responsibility in connection with any of the foregoing. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period; Account will be charged for renewal within 24 hours prior to the end of the current period, and identify the cost of the renewal; Subscriptions can be managed by the user: You can turn off automatic renewal after purchase through the application platform's "Subscription Management"; No cancellation of the current subscription is allowed during active subscription period. Refunds. Unless otherwise specified in these Terms of Service or required under the applicable law in your jurisdiction, any digital goods including gold coins and Subscription Services are not refundable after purchase.

Copyright Complaints

Binmo respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify Binmo of your infringement claim in accordance with the procedure set forth below. Binmo will process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws with respect to any alleged or actual infringement. To be effective, the notification must be in writing and contain the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; a description of the copyrighted work or other intellectual property that you claim has been infringed; a description of where the material that you claim is infringing is located on the Binmo Service, with enough detail that we may find it on the Binmo Service; your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf. If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to upload and use the content in your content, you may send a written counter-notice containing the following information to the Copyright Agent: your physical or electronic signature; identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled; a statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the competent court located within BVI and a statement that you will accept service of process from the person who provided notification of the alleged infringement. If a counter-notice is received by the Copyright Agent, Binmo will send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.
